The Master Plan

The city of Boerne’s Master Plan is a document that is updated at least every 10 years, synthesizing the suggestions of citizens, city staff and urban architects to illustrate and clarify appropriate land use and zoning throughout the city and neighboring region.

According to text from the Master Plan, it is “…a composite of the community’s vision and goals. Simply, the plan is a roadmap to the future desired by the residents and stakeholders of Boerne.” It further states that “the plan will be implemented through the Boerne Zoning and Subdivision Regulations.”

Additionally, Texas law is explicit in regard to zoning that violates a city's Master Plan:

“...adopted plan must serve as basis for zoning amendments..”

Mayhew vs. Sunnyvale

“...forbids actions that disregard long-range master plans...”

Pharr vs. Tippit

The current Master Plan designates 17 Herff Road as a residential area, reflecting the preferences and suggestions of citizens, staff and urban designers during its creation.

In the case of 17 Herff, the stated reasoning behind the recommendation of the MU-2 and R-4 permanent zoning was:

1. Herff Road expansion

2. the 23 acres of vacant land immediately across the road from 17 Herff.

City staff sees this area as potentially commercial or high density.

Per city staff, “The same would apply across the street as it does at this location. So the MU-2/R-4 zoning is appropriate for this site.”

The parcel they are referring to reflects low-density residential on the Future Land Use/Development Plan adopted 10/27/2010.

So, it is not an exaggeration to view 17 Herff as a domino in the reshaping of Herff, Old San Antonio, and surrounding neighborhood streets.
